Beyond Gravity Terms of Service

Key points

These Terms govern your use of Beyond Gravity, a location-based calisthenics game operated by Creator Flows.

• You must be at least 16 years old to use Beyond Gravity.
• If you are under the age of legal majority where you live, you must have any parent or guardian permission required by applicable law.
• Location is used to verify real-world gameplay. Never trespass, enter unsafe areas, or use the app while driving.
• Training, outdoor exercise, parks and equipment involve real-world risks. You remain responsible for deciding whether an activity, location or piece of equipment is safe and suitable for you.
• Cheating, GPS spoofing, bots, exploit abuse, harassment and illegal content are prohibited.
• Gym claims, XP, ranks, badges and other in-game status are virtual game mechanics. They do not give you ownership of, or exclusive rights over, any real-world park or property.
• Beyond Gravity is under active development. We may rebalance, change or remove game mechanics, maps, progression or experimental features.
• You can delete your account through the app. You do not need to accept a new version of the Terms in order to access account deletion.

1. About these Terms

These Terms of Service (the "Terms") form an agreement between you and Vivek Ganeshie, trading as Creator Flows ("Creator Flows", "Beyond Gravity", "we", "us" or "our"), regarding your access to and use of Beyond Gravity.

By creating an account and selecting "I agree to the Terms of Service", or by continuing to use Beyond Gravity after accepting the applicable version of these Terms, you agree to be bound by them.

Our Privacy Policy explains how we process personal data. Acknowledging the Privacy Policy is separate from agreeing to these Terms.

2. Eligibility and users aged 16 or 17

Beyond Gravity is intended only for people aged 16 and older. You may not create or use an account if you are under 16.

We currently use an age declaration rather than collecting your date of birth or performing identity-based age verification. When you confirm that you are at least 16, you must provide that declaration truthfully.

If you are 16 or 17, or otherwise below the age at which you can independently enter into this agreement where you live, you may use Beyond Gravity only if your use is permitted by applicable law and you have any parent or guardian permission that applicable law requires. This is particularly important before entering into any paid transaction if paid features are introduced in the future.

If we reasonably believe an account is being used by someone who is not eligible to use the service, we may restrict, suspend or delete the account, subject to applicable law.

3. Accounts and account security

You may be able to register using email/password authentication or a supported third-party sign-in provider such as Google or Apple.

• Provide accurate information where the app asks for it and do not impersonate another person.
• Keep your credentials, device and authentication session secure.
• Do not sell, transfer or share access to an account in a way that undermines account security or fair play.
• Tell us promptly at gainestics@gmail.com if you believe your account has been compromised.

You are responsible for activity performed through your account to the extent permitted by applicable law. We may require reauthentication or other reasonable security steps for sensitive account actions.

4. The Beyond Gravity service

Beyond Gravity combines real-world calisthenics locations with digital gameplay. Features may include maps, park discovery, verified visits, training sessions, gym claims, progression, XP, quests, achievements, rankings, social features, chat and other game systems.

In-game records are game mechanics only. A gym or park claim does not mean that you own, lease, control or have priority access to the real-world location. It does not give you the right to exclude other users or members of the public.

You must comply with the rules, opening hours and lawful instructions that apply at every real-world location.

5. Location services and real-world movement

Some Beyond Gravity features require location permission. Your device may provide latitude, longitude, accuracy and timestamps so that we can determine whether you are near a relevant park or whether a location-based action is plausible.

You must not use Beyond Gravity in a way that creates a safety risk. In particular:

• Do not use the app while driving or operating a vehicle.
• Do not trespass or enter private, closed, restricted or hazardous property.
• Do not climb fences, enter construction sites, cross dangerous terrain or ignore local warnings in order to reach an in-game location.
• Stay aware of traffic, weather, lighting, other people and your surroundings.
• Follow local laws and park rules.

If an in-app map, marker or instruction appears inconsistent with the real world, the real-world situation takes priority. Do not continue toward a location that appears unsafe or inaccessible.

6. Exercise, equipment and physical safety

Calisthenics, strength training and outdoor exercise can involve risks including falls, overexertion, equipment failure and injury. Beyond Gravity is a game and software service; it is not medical advice, diagnosis, physiotherapy or a personalised professional training service.

You are responsible for deciding whether an exercise, challenge, park or piece of equipment is suitable for you. Use equipment as intended, inspect it before use where reasonable, and stop if conditions appear unsafe.

If you have concerns about your health or ability to exercise safely, seek appropriate professional advice before participating. Nothing in these Terms limits liability that cannot lawfully be excluded.

7. Maps, parks and third-party location information

Park locations, names, map tiles, imagery, descriptions and other geographic information may come from public datasets, community sources or third-party providers. This information can be incomplete, outdated, duplicated or inaccurate.

We do not guarantee that a park exists, is open, is publicly accessible, contains particular equipment, remains safe, or permits the activity you intend to perform.

You should verify important real-world information yourself. If you discover materially incorrect park information, you may contact us so that we can investigate.

8. Fair play and anti-cheat

Beyond Gravity is designed around real-world activity and fair competition. You must not manipulate the service or other players' experience.

Prohibited conduct includes:

• GPS spoofing, fabricated location data or other attempts to appear at a place where you are not physically present.
• Bots, scripts, automation or macros used to gain an unfair gameplay advantage unless we have expressly authorised them.
• Exploiting bugs, race conditions, duplicate rewards or other defects instead of reporting them.
• Coordinating or using multiple accounts to manipulate claims, progression, rankings or rewards.
• Tampering with requests, authentication, APIs, databases or clients to bypass gameplay restrictions.
• Scraping or extracting non-public data, or attempting to obtain access to another user's account or private information.

We may use automated and manual anti-abuse systems to identify suspicious activity. If a bug, exploit or abuse materially affects game integrity, we may correct affected XP, claims, rankings, rewards or other game state. Where applicable law requires it, we will provide information about moderation or restriction decisions and available ways to challenge them.

9. Community rules and user content

Beyond Gravity may allow you to create a username, upload an avatar, post Gym Chat or World Chat messages, or otherwise submit or display content ("User Content"). You remain responsible for User Content you submit.

You must not submit, promote or distribute User Content that:

• is illegal, fraudulent or encourages unlawful conduct;
• threatens, harasses, stalks, bullies or deliberately intimidates another person;
• contains hateful or discriminatory attacks directed at protected characteristics;
• contains sexual exploitation material, non-consensual sexual content or pornographic content inappropriate for a 16+ community;
• publishes another person's private information without an appropriate basis, including doxxing or exposing precise private locations;
• infringes intellectual property, privacy, publicity or other rights;
• contains malware, phishing, scams, spam or deceptive commercial promotion;
• shares instructions or tools intended to cheat, attack or compromise Beyond Gravity.

Additional Community Guidelines displayed in the service may provide more specific rules. If those guidelines conflict with these Terms, these Terms prevail unless we expressly state otherwise.

10. Your rights in User Content and the licence you give us

You retain ownership of the User Content you create, subject to any rights belonging to third parties.

To operate Beyond Gravity, you grant Creator Flows a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, format and technically process your User Content only as reasonably necessary to provide, secure, moderate and improve the service.

This licence also allows us to make User Content available to other users where you use a feature that is designed to be public or shared, such as Gym Chat, World Chat or a public profile.

The licence ends when the relevant User Content is deleted from our active systems, except to the extent temporary technical retention, legal obligations, dispute resolution or security requirements lawfully require otherwise.

You represent that you have the rights necessary to submit your User Content and to grant the licence described above.

11. Reporting content, moderation and complaints

We may review, restrict, remove or disable access to User Content or accounts where we reasonably believe this is necessary to enforce these Terms, protect users or the service, respond to illegal content, comply with law, or investigate security and abuse.

You can report suspected illegal content, serious abuse, or a moderation concern by contacting gainestics@gmail.com. Please include enough information for us to identify the content or account and understand the issue. Do not send unnecessary sensitive personal data.

Where applicable law requires us to provide reasons for a content or account restriction, or a mechanism to challenge such a decision, we will do so. You may also contact us at gainestics@gmail.com if you believe a moderation action was made in error.

We may preserve relevant evidence where reasonably necessary to investigate abuse, comply with law or establish, exercise or defend legal claims.

12. Our intellectual property

Beyond Gravity, including its software, original visual design, branding, game systems, text, graphics and other original materials, is owned by or licensed to Creator Flows and is protected by applicable intellectual property laws.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable right to use Beyond Gravity for its intended purpose.

Except where applicable law expressly permits it, you may not copy, resell, sublicense, reverse engineer, circumvent security controls, reproduce substantial parts of the service, or use our branding in a way that suggests endorsement.

Third-party maps, fonts, libraries, datasets and other materials remain subject to their respective licences and rights.

13. Third-party services

Beyond Gravity relies on third-party services and infrastructure, which may include Supabase for authentication, database, storage and server functions; Google and Apple for optional sign-in; Google for font delivery; and CARTO or related mapping providers for map styles and tiles.

Third-party services may have their own terms, availability rules and privacy practices. We are not responsible for independent third-party services to the extent permitted by law, but this does not affect any rights you have against us that cannot legally be excluded.

14. Beta features, balancing and changes to game state

Beyond Gravity is under active development. Features may be experimental, incomplete or changed as the game evolves.

We may add, rebalance, rename, reset, restrict or remove features, quests, achievements, XP values, ranks, park classifications, claims, leaderboards, rewards and other game mechanics where reasonably necessary to develop the service, preserve fair play, correct errors or maintain technical stability.

We will not intentionally alter paid entitlements in a way that overrides mandatory consumer rights. If a future change materially affects a paid product, any applicable consumer protections remain available.

15. Paid features and virtual items

The current version of these Terms is primarily written for the current service before a general paid virtual-item or subscription system is launched.

If Beyond Gravity introduces paid subscriptions, Territory Coins, Pioneer items, virtual goods or other paid digital content, we may present additional purchase terms and update these Terms before those products are offered.

Until such paid features are introduced under applicable purchase terms, in-game XP, ranks, claims, titles, achievements and other status indicators are not money, legal tender or financial instruments and have no guaranteed cash value.

Nothing in this section limits statutory consumer rights that apply to a future purchase.

16. Suspension and termination

You may stop using Beyond Gravity at any time.

We may warn, restrict, suspend or terminate an account where reasonably necessary because of a material or repeated breach of these Terms, cheating, security threats, illegal activity, harm to other users, or a legal requirement.

Where appropriate, we will consider the seriousness, frequency and context of the conduct. Where applicable law requires notice, reasons, an opportunity to complain or another remedy, we will provide it.

We may take immediate protective action where reasonably necessary to address an urgent security risk, serious abuse, illegal content or risk of harm.

17. Account deletion

You can request permanent account deletion through the account controls provided in Beyond Gravity.

You do not need to accept a new version of these Terms in order to access the account deletion function.

Deletion is intended to remove the authenticated account and associated account-linked data as described in our Privacy Policy. Non-personal game-world information, such as the existence of a park, may remain because it is not owned by or specific to your account.

Once deletion has successfully completed, it may not be possible to restore your previous progression, claims, achievements or account state. Signing in again may create a new, empty account.

18. Availability and service changes

We aim to keep Beyond Gravity available and functional, but we do not guarantee uninterrupted or error-free operation. Maintenance, software defects, network failures, third-party outages, security incidents or other events may temporarily affect the service.

We may modify or discontinue parts of Beyond Gravity. If we permanently discontinue a paid service in the future, we will handle affected paid rights in accordance with applicable law and the purchase terms in force at that time.

19. Disclaimers

To the extent permitted by law, Beyond Gravity is provided on an "as available" basis. We do not guarantee that every map location, park, ranking, claim, challenge, user-generated statement or third-party resource is complete, accurate, safe or continuously available.

We do not control public parks, outdoor equipment, weather, other park users, local authorities or third-party premises. Real-world conditions may change without being reflected in the app.

Nothing in these Terms excludes warranties, guarantees or other rights that applicable consumer law says cannot be excluded.

20. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that applicable law does not allow us to exclude or limit.

Subject to that rule, Creator Flows is not responsible for losses that were not reasonably foreseeable when you agreed to these Terms, or for losses caused solely by events outside our reasonable control.

To the extent permitted by law, we are not liable for indirect commercial losses such as loss of profit, revenue, business opportunity or goodwill arising from personal, non-business use of the service.

You remain responsible for your real-world decisions, including where you travel, whether you enter or use a park, and whether a particular exercise or piece of equipment is appropriate for you. This does not exclude liability for our own conduct where applicable law makes us responsible.

21. Privacy

Our Privacy Policy explains what personal data Beyond Gravity processes, why it is processed, the services we use, retention, account deletion and your privacy rights.

The Privacy Policy is not incorporated as a blanket consent mechanism. Where applicable law requires a specific consent for a particular processing activity, we will request that separately.

22. Governing law and disputes

These Terms are governed by the laws of the Netherlands.

If you are a consumer, this choice of law does not deprive you of mandatory protections that apply under the law of your country of residence.

We encourage you to contact us first at gainestics@gmail.com so that we can try to resolve a dispute informally.

Any dispute may be brought before a competent court in accordance with applicable procedural and consumer-protection law. Nothing in these Terms requires a consumer to give up a mandatory right to bring proceedings in a court that applicable law makes available to them.

23. Changes to these Terms

We may update these Terms as Beyond Gravity develops, for example when we add features, paid products, new community systems, new legal requirements or material changes to the service.

The current version and effective date are shown at the top of the Terms.

If a change is material, we may require authenticated users to review and accept the new version before continuing to use ordinary gameplay features. Users who do not wish to accept a new version will still be able to access reasonable account-exit options, including account deletion, where required.

24. General provisions

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

If we do not enforce a provision immediately, that does not mean we permanently waive our right to enforce it.

You may not transfer your account or your rights under these Terms in a way that conflicts with these Terms. We may transfer the operation of Beyond Gravity as part of a lawful business reorganisation, acquisition or transfer, subject to applicable law and our privacy obligations.

These Terms, together with any expressly incorporated service rules or future purchase terms, form the agreement governing your use of Beyond Gravity.
